Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MatchFlow3D website at matchflow3d.com (the "Service"), operated by MatchFlow3D ("we," "us," or "MatchFlow3D"), a sole proprietorship based in Georgia, USA. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

MatchFlow3D is a web-based tool for designing layouts of practical shooting sport stages and producing stage briefings. The Service is offered "as-is" and may be updated, modified, or discontinued at any time without notice.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service you confirm that you are at least 13 and have the legal capacity to enter into these Terms. If you are between 13 and 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at dylan@matchflow3d.com if you suspect unauthorized use.

4. Premium Features and Payment

Certain features (including cloud saves, PDF export, printing, and sharing) are available only with a premium upgrade. The premium upgrade is a one-time purchase of US $5.00 and grants lifetime access to premium features for the purchasing account, subject to these Terms and to the continued availability of the Service.

Payment is processed by Stripe. By purchasing, you agree to Stripe's terms and authorize us, through Stripe, to charge your payment method.

5. Refunds

Refunds are issued at our sole discretion. To request a refund, email dylan@matchflow3d.com within a reasonable time of your purchase and explain the reason. We typically grant refunds for accidental purchases or for technical issues that prevent you from using the premium features. Approved refunds are issued to the original payment method.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to other accounts, our infrastructure, or any data belonging to other users.
• Reverse engineer, decompile, or attempt to extract the source code of the Service except to the extent permitted by applicable law.
• Use automated tools to crawl, scrape, or place excessive load on the Service.
• Resell, sublicense, or redistribute access to the Service.
• Upload content that is illegal, threatening, harassing, or infringing on third-party rights.

We reserve the right to suspend or terminate accounts that violate these Terms.

7. User Content

You retain ownership of stage layouts and other content you create using the Service ("User Content"). By saving User Content to the cloud, you grant us a limited license to store and display it back to you so that we can provide the Service. You are responsible for your User Content and represent that you have the right to create and upload it.

8. Intellectual Property

The Service, including all software, designs, text, logos, and the MatchFlow3D name, is owned by us and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

9. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or availability. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any data will be retained without loss.

Stage layouts produced by the Service are intended as planning aids only. You are solely responsible for ensuring that any stage you build conforms to the rules of your governing organization and to applicable safety standards. We make no representation that any layout produced by the Service is rules-compliant or safe.

10. Limitation of Liability

To the maximum extent permitted by law, MatchFlow3D and its operator are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim related to the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim, or US $5.00, whichever is greater.

11. Indemnification

You agree to indemnify and hold MatchFlow3D and its operator harmless from any claim, loss, or demand (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

12. Termination

You may stop using the Service or delete your account at any time by emailing dylan@matchflow3d.com. We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and governing law) will survive.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Effective date" above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Georgia, and you consent to personal jurisdiction in those courts.
